Strategies and Tactics for Successfully Resolving Construction Claims takes place on Wednesday, May 5 from 11 AM to 12 PM, featuring attorneys Grant Degginger and Andrew Gabel from Lane Powell’s Government Law Team. Grant and Andrew will be speaking on key construction contract provisions and mediation strategies that can contribute to a successful construction claim mediation. This webinar will be of use to anyone who manages public works projects, large or small. As an added bonus, attendees can earn continuing education credit, including CLE, CM, Legal CM, and APWA-CAEC.

Webinar Overview

Delivering public works construction projects on time and within budget never has been more challenging. The pandemic, labor shortages, supply chain disruptions all mean that in order to avoid significant construction claim risk, local governments must adopt effective claims management strategies throughout the life of the project. This webinar will focus on key construction contract provisions and mediation strategies that can contribute to a successful construction claim mediation.

This webinar will focus on resolving construction claims through contract-related risk management, effective project documentation, claim recognition, and mediation tactics. Key construction contract provisions to be addressed include:

  • Notice provisions
  • Indemnity
  • Insurance
  • Audit rights, and
  • Dispute resolution, including mediation requirements and timing.

The following topics related to mediation strategies will also be addressed:

  • Qualities of a successful construction mediator
  • Requiring information exchanges in advance of mediation
  • Ensuring that all necessary parties will participate

  • Use of experts in mediation and strategies if mediation is unsuccessful

Presenters

  • Grant Degginger, Attorney, Lane Powell. Grant is the Chair of the firm’s Government Law Team. His practice combines three decades of solving complex contract, construction and environmental disputes with his experience in federal, state, and local governments.
  • Andrew Gabel, Attorney, Lane Powell. Andrew represents design professionals, public and private owners, contractors, product manufacturers and insurers in construction and real estate matters. He serves as a strategic advisor at all stages of the project, and helps clients anticipate and remove roadblocks.
  • Flannary Collins, Managing Attorney, MRSC. Flannary will serve as the webinar moderator.
